1.  A Few things to Begin With

First, thank you for using BCre8ive. Your trust is always important to us, so we are making changes to our Privacy Policy to explain how we collect, store and handle your personal information (data).

The updated Privacy Policy will automatically come into effect for all existing users on 25 May 2018. In line with the new General Data Protection Regulations (GDPR)

Who is BCre8ive?

‘BCre8ive’ means the company BCre8ive Ltd., and it’s website which can be accessed at https//www.bcre8ive.eu. The ‘Website’ means the BCre8ive website and includes:

  • All Web Pages
  • Mirror sites controlled by us that are accessible from the homepage
  • All online functionality and services available from the ‘Website’
  • All virtual workshops and other online workspaces accessed from the Website following your registration

Who is “You”?

We refer to “you” a lot in this Privacy Policy. When we use the term ‘You’ it means everyone who engages with BCre8ive .  ‘You’ includes:

Creatives:  Individual Registered Users of the services provided by the website

Mentors:  Individuals with relevant experience and expertise introduced via the Website to an individual, and/or a Group, to advise on the development of creative content on the Website.

Lab Companies:  Representatives from Production Companies who register on the site to assist in development of creative content during a Lab or at other times that may be agreed with BCre8ive

People who receive our Newsletter:  Individuals who have either registered to receive the Newsletter directly via the Website or via our Third Party provider (Mail Chimp) or who have other association with the work, services and/or information provided by BCre8ive.

 

BCre8ive is committed to protecting your personal information and any information that is provided by you to us will be stored and used by us in accordance with the General Data Protection Regulations 2018 and Data Protection Act 1998.

This Privacy Policy together with the Terms and Conditions of the Registered User Agreement posted on the Website list the general rules and policies governing your use of our Website.

2.   Who is responsible for Controlling and Processing my Information (Data)?

BCre8ive Ltd is the Controller of the data stored and managed via the Website (www.bcre8ive.eu). Data is Processed by Netready Ltd on behalf of BCre8ive.

3.  Why does BCre8ive Collect Information about me?

We collect information for reasons that include making the Website work better for you, allowing us to communicate with you and to provide information and answer any queries that you may have. See Sections 4 and 5 (“What Information will BCre8ive collect about me?” and “How will BCre8ive use the information it collects about me”) for more detail.

4.  What Information will BCre8ive Collect about me?

Information that is essential for the use of the BCre8ive website platform.

When you register with BCre8ive we’ll ask for personal information such as your name, email address, postal address, telephone or mobile number.

We will also ask for other information eg age group, gender, country in which you are located and language skills.

You will also be asked to choose a unique username and a password, which will be used solely for the purpose of providing access to your Registered User Account.

If you choose not to provide your personal information we will be unable to confirm your registration or provide you with the BCre8ive services, activities or access to the online content available on the Website

In addition, BCre8ive also collects certain non-personal information from you when you access the Website.  Examples of non-personal information we may collect include:

  • Internet protocol addresses (a number automatically assigned to your computer when you connect to the internet)
  • The type of browser you are using (e.g., Internet Explorer, Firefox, Safari, etc.),
  • Language of your browser
  • Any third party website from which your visit originated,
  • The operating system you are using (e.g. Windows XP, Mac OS, etc.),
  • The name of your Internet service provider (e.g., British Telecom, Virgin, Orange etc.),
  • The search terms you use on our Website,
  • Your activities on the site and patterns of use
  • The time, frequency and duration of your visits.

5. How will BCre8ive use the information it collects about me?

BCre8ive will use your personal information in the following ways:

  • To provide our services, activities or online content and to deal with your requests and enquiries (e.g., allocating you to groups, chats and voting activities),
  • For "service administration purposes", which means that BCre8ive may contact you for reasons related to the service, activity or online content you have signed up for (e.g. to provide you with password reminders or to notify you that a particular service, activity or online content has been suspended for maintenance);
  • To make information, that you choose to be available to other website users, visible in the ‘Talent Pool’
  • To contact you about a submission you have made, including any content you provide.
  • To provide you with information about our services, activities or online content including via our Newsletters;
  • To track and archive Content that you have uploaded to the site or have developed in full or in part using the facilities of the site, in order to provide you with a verifiable record of your Intellectual Property rights in such Content
  • To use Internet protocol addresses to identify the location of users, to block disruptive use, to establish the number of visits from different parts of the UK and from different countries.
  • To analyse and improve the services offered at the website;
  • To provide you with the most user-friendly navigation experience.
  • BCre8ive may also use and disclose information in aggregate (e.g. numbers of people registered on the site, geographic breakdown of users, percentage of users in different age groups). This tyoe of aggregate use of information will not identify individuals and may be used for purposes such as marketing, raising of finance and strategic development.

6.  Third Parties: Who else collects information about me?

Generally, we will only use your information within BCre8ive in order to provide our Website services. However, sometimes BCre8ive does need to use the following third parties:

Payments

Where payments are required for selected services on the site such as hiring a mentor, financial information relating to such payments is separately handled by independent payment specialists Sage Pay and Pay Pal. BCre8ive Ltd does not at any time record or store any financial information about you or any of its users.

All financial transactions are independently managed by Sage Pay and Pay Pal and the information that you provide to these organisations will be governed by their separate Privacy Policies Sage Pay Privacy  Pay Pal Privacy

BCre8ive E-newsletter

We use a third party provider, Mail Chimp to deliver our e-newsletters. We gather statistics around email opening and clicks using industry standard technologies including clear gifs to help us monitor and improve our e-newsletter. For more information, please see Mail Chimp’s privacy notice.

BCre8ive Blog: WordPress

We use a third party service, WordPress.com, to publish our blog, Wordpress.com is run by Automattic Inc. We use a standard WordPress service to collect anonymous information only about users' activity on the blog site, for example the number of users viewing pages on the site, to monitor and report on the effectiveness of the site and help us improve it. WordPress requires visitors that want to post a comment to enter a name and email address. For more information about how WordPress processes data, please see Automattic's privacy notice.

Skype

For users who wish to use it, we offer a connection to the Skype communication network. Skype is owned by Microsoft and their Legal terms and Privacy Policy can be accessed here

Analytics:

Additionally, we use a third party service, such as Google Analytics, to collect standard internet log information and details of visitor behaviour patterns. We do this to find out things such as the number of visitors to the various parts of the site. This information is processed in a way which does not identify individuals.

BCre8ive requires such third parties to comply strictly with its instructions and requires that they do not use your personal information for their own business purposes, unless you have explicitly consented to the use of your personal information in this way.

Use of Public Forums

BCre8ive may from time to time offer links to public chat rooms, message boards, bulletin boards, or similar forums/networks, where you and other users of our Website may choose to communicate. Such sites operate under separate privacy arrangements and the protections described in this Privacy Policy do not apply when you provide information (including personal information) in connection with your use of third party public forums. BCre8ive is not responsible for events arising from the distribution of any information you choose to publicly post or share using such links from our Website  (See also Section 10 below  "Links to Other Websites")

7.  When will BCre8ive contact me?

BCre8ive may contact you:

  • In relation to any service, activity or online content you have signed up for in order to ensure that we can deliver the services to you;
  • In relation to any correspondence we receive from you or any comment or complaint you make about BCre8ive products or services;
  • To invite you to participate in surveys about BCre8ive services (participation is always voluntary); and
  • Via our newsletters to inform you of news and information relating to BCre8ive activities, wider developments relating to the creative industries generally and opportunities for training, competitions and events that may be of interest to you as a user of BCre8ive services
  • For marketing purposes, as described in section 8 below

8. Will I be contacted for marketing purposes?

  • BCre8ive may contact its users and readers through its newsletter with information relating to BCre8ive and its activities plus third party information relevant to the Creative Industries including conferences, events, competitions and awards organised by others. 
  • BCre8ive does not employ any form of direct advertising on either its Website or in its Newsletter.
  • BCre8ive will not sell personal information or otherwise knowingly make personal information available to third party advertisers.

9.  Will BCre8ive share my personal information with anyone else?

By submitting material to us you grant us a non-exclusive license as described in the Registered User Agreement to make your content available on the Website or other portals of the Platform. We shall not disclose personal data other than your user name to other parties without your express or implied consent

Applications of Law

Again in accordance with the Registered User Agreement, we may disclose your identity to a third party without further consent, in circumstances where it is required by law. (See also Section 11 below ‘Offensive, inappropriate or illegal content on BCre8ive websites’).

In the event that we are contacted by any person who claims that that any material posted or uploaded by you to the Website constitutes a violation of their intellectual property rights or their right to privacy, we will contact you to advise you that such a claim has been made and may provide your name to the person/persons concerned.

10.  Links to Other Websites

The BCre8ive website may from time-to-time contain links to websites owned and operated by third parties. These third party websites have their own privacy policies, and are also likely to use cookies. If you go to another website from this one, please read the Privacy Policy on their website if you want to know what it does with your information. We cannot control and do not accept any responsibility or liability for the privacy practices of such third party websites. Your use of links to such websites and/or engagement with such websites is at your own risk.

11. Offensive, inappropriate or illegal content on BCre8ive websites

BCre8ive may use your personal information to stop selected activities in the following circumstances:

  1. If you use the BCre8ive Website for any fraudulent purpose, or in connection with a criminal offence or other unlawful or immoral activity,
  2. If you post or send any content or material that:
  • Is illegal, offensive, abusive, indecent, defamatory, obscene or menacing
  • will infringe copyright, trademark, confidence, privacy or any other right or is otherwise injurious or objectionable to third parties,
  • consists of or contains software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or other types of spam
  • in any way may cause annoyance, inconvenience or needless anxiety,

Where BCre8ive reasonably believes that you are or may be in breach of any applicable laws (e.g. because content you have posted may be defamatory or infringes copyright or any other right), BCre8ive may use your personal information to inform relevant third parties about the content and your behaviour.

12.  Can I use the BCre8ive website if I am under the age of 18?

We regret that the services provided by the BCre8ive website are not available to anyone under the age of 18 as we require all people registering for the site to agree to legally binding terms and conditions and you must be over 18 in order to enter into this contract.

New users are therefore asked to confirm that they are aged 18 or over at the point of registration for the main part of the site.

Access to the newsletter is available people under the age of 18

  • NOTE: BCre8ive Ltd. does not knowingly collect personally identifiable information from people under the age of 18 . If you are a parent or guardian of a person under the age of 18 and believe he or she has disclosed personally identifiable information to us please contact us at privacy@bcre8ive.eu

13. How easy is it to change my personal information once I have registered?

We provide registered users with full access to their personal Information through their personal pages on the website and users may correct, change or update personal information at any time during the period that they are registered with BCre8ive.  See also (Section 15 below "Can I find out what personal information holds about me?")

 14. How long will BCre8ive keep my personal information?

We will hold your personal information on our systems for as long as is necessary for the relevant activities, or as long as is set out in any relevant contract you hold with BCre8ive. In accordance with GDPR you may cancel your registration or membership of any group at any time. Cancellation of group memberships within the site will mean that other members of that group no longer have any access to your information

If you cancel your User Registration at BCre8ive, while BCre8ive cannot use the personal information without your further consent, it remains archived in order for us to be able to access a verifiable record of your Intellectual Property ownership in full or in part of any artefact or group artefact. (There is a nominal administration charge of £10.00 for retrieving archived information) Requests can be made at admin@bcre8ive.eu

  • NOTE: If you cease to be a member of BCre8ive you will have the opportunity to ask us to delete your records in their entirety. If you do this we will no longer be able to offer to provide such verifiable records of your Intellectual Property ownership.

 15. Can I find out what personal information BCre8ive holds about me?

While you are registered with BCre8ive, your personal information remains fully available to you and within your control on the Website. It can be viewed and amended by you at any time.

If you cease to be registered with the site, as explained in Section 14 above, we retain an archive of your information for the reasons explained. During such a period, you will not have access to the Website but you have the right to request a copy of the personal information BCre8ive holds about you and to have any inaccuracies corrected. Requests can be made at privacy@bcre8ive.eu

We charge £10 for information requests and for security reasons require you to prove your identity with 2 pieces of approved identification). We will use reasonable efforts to supply, correct or delete personal information about you on our files.

 16. Information Storage, and Transmission

Storage

We store and maintain files, documents, emails and other data stored in your user account data on secure servers and utilise security devices such as firewalls to protect personal information

In order to prevent loss of data due to errors or system failures, we also keep backup copies of data including the contents of your user account.

Transmission

Unfortunately, the transmission of information via the internet is not completely secure. Transmissions are therefore at your own risk. Once we have received your information, we will use procedures and security features to do our best to prevent unauthorised access.

 17. Cookies - Information BCre8ive collects from you

What is a cookie?

A cookie is a small package of data that is sent to your computer, tablet or mobile phone (referred to here as a "device") browser from a website's computer and is stored on your device's hard drive.

How does BCre8ive use cookies?

If you create an account with us then we will use cookies for the management of the signup process and general administration. These cookies will usually be deleted when you log out. We use cookies when you are logged in to prevent the need for you to log in every single time you visit a new page.

In some special cases we also use cookies provided by trusted third parties (e.g. Google analytics to help us understand how you use the site)

 18. Changes to BCre8ive's Privacy Policy

BCre8ive may update this Privacy Policy from time to time. Any amendments to the Privacy Policy Statement will be posted on our website in order to keep you informed of any changes to the nature of information collected, manner of collection, use and sharing of information.
